Rydyt’s privacy policy (“Privacy Policy”)

The Users may download the App on multiple Compatible Mobile Phones. Downloading the App is at the User’s sole risk.

When the User registers with Rydyt, the User represents that: (a) the contact information that the User submits is truthful, complete and accurate; and (b) the User will update their contact information if it changes so that Rydyt can contact the User in accordance with these Terms.

Road information prevails. The information provided by the Service is not intended to replace the information provided on the road, such as travel direction, time based restrictions, lane restrictions, road blockades, traffic signs, traffic lights, police instructions, etc.

Cautious driving. Always drive vigilantly according to road conditions and in accordance with traffic laws. It is strictly forbidden to send traffic updates (such as updates on road accidents and traffic congestion), or to non-verbally interact with the Service or use the Service in a non-verbal manner for any purpose other than navigation while driving. Traffic updates or non-verbal reports you want to submit to the Service may only be sent after you have stopped your vehicle in an appropriate location permitted by law. Alternatively, such updates may be sent by a passenger other than the driver, provided it does not interfere with the due course of driving and does not distract the driver’s attention to the road.

Non-continuous updates. The information provided by the Service originates from other users of the Service. Such information is intrinsically fluctuant and may be inaccurate, incomplete or outdated. Rydyt does not provide any warranties to such information’s credibility or reliability.

Location-based Service. Some features of the Service make use of detailed location and route information, for example in the form of GPS signals and other information sent by your mobile device on which the Rydyt application is installed and activated. These features cannot be provided without utilizing this technology. Please note, as described in detail in the Privacy Policy.

Rydyt uses your location and route information to create a detailed route history of all of your journeys made when using the Service. Rydyt uses this history to offer the Service to you, to improve the quality of the Service it offers to you and to all of its users, to improve the accuracy of its mapping and navigation data, and more as described in detail in the Privacy Policy. This history is associated with your account and username (if you have chosen to set up a username). This history is retained by Rydyt for a limited period of time and in accordance with the Privacy Policy.

Rydyt allows you to use the Service whether or not you choose to set up a username for yourself. If you choose to use the Service without setting up a username you may do so by skipping the username setup stage of the application installation process. Rydyt will still link all of your information with your account and a unique identifier generated by Rydyt in accordance with the Privacy Policy. Note that in order to access certain features of the Service (for example map editing, ranking, moods) you will need to set up a username.

Advertisements. Third party advertisements may appear on the Service from time to time. Rydyt does not endorse these advertisements, and the advertisements are not intended to be, nor should they be, viewed by drivers unless and until their vehicle has come to a complete stop.

The Internet connection required to use the Service, and any associated charges (e.g. mobile data expenses) incurred by your use of the Service are your exclusive responsibility and made solely at your expense. Transmitting and receiving real-time updates to and from the Service, requires an online (e.g. Wi-Fi, 3G, 4G) connection between your cellular device and the Internet. The expenses of such connection are as prescribed by the agreement between you and your communication service provider (such as your cellular company), and according to its applicable terms of payment.

Free Software. The Service utilizes Software for map displays, updates and road information. With respect to some cellular telephone devices running the Software, the Software is a free-software. In such cases you may redistribute the Software or modify it in accordance with the GNU General Public License as published by the Free Software Foundation, whether it is version 2.0 of the license or any later version of your choice. For further information, see the GNU General Public License. The Service, its database, Rydyt’s trademarks, the design of the maps of the Service and the voice files integrated in the Software – all are not free-software.

Your age. The Service is intended for use by users who are of the legal age required to hold a driving license. In any case, to use our Service you must be 18 years of age or older. If you are under 18, you may not download or use the Service. Accounts of users under the age of 18 years will be canceled and deleted by Rydyt, upon receiving notice.

Privacy. Your privacy is important to us. While using the Service, personal information may be provided by You or collected by Rydyt as detailed in our Privacy Policy. The Privacy Policy explains our practices pertaining to the use of your personal information and we ask that you read such Privacy Policy carefully. By accepting these Terms, you hereby acknowledge and agree to the collection, storage and use of your personal information by Rydyt, subject to this section, the Privacy Policy and any applicable laws and regulation

In connection with the Users’ use of the App, Rydyt grants to the Users a non-exclusive, temporary, revocable, non-transferable, non-sub-licensable licence (the “Licence”) to use the App and the relevant software solely for personal, non-commercial purposes and solely through the Rydyt-provided interface and in accordance with these Terms (Any use of the App not expressly provided by these Terms is prohibited. Therefore, by way of example only, the User shall not and shall not allow any third party to: (a) reproduce, copy, post, modify, create a derivative work of, reverse engineer, de-compile, disassemble, reverse assemble or otherwise attempt to discover, in whole or in part, any source code material or data related to the App (the “Content”); (b) rent, loan, share, publicly perform or display, sell, transfer or otherwise distribute the App or the Content to third parties; (c) permit the App to be combined with, or become incorporated in, any other programs, except as necessary to use the App;(d) send or otherwise make available any file or program that might damage or alter proper working of any hardware, software or equipment; or (e) transfer or assign their Access Data.

The User is aware and acknowledges that Rydyt may change the technical features of the App at any time and may periodically make improvements, modifications, upgrades, integrations or updates available to the User (“Upgrades”). Such Upgrades may impact the functionality of the App and Rydyt shall have no liability whatsoever due to User’s failure to install any such Upgrades. The Use of Upgrades will also be governed by these Terms. The License will be effective until the User ceases using the App, or until Rydyt terminates the User’s account in accordance with the rules and law, or upon Rydyt’s withdrawal or termination of the App.

You may terminate your use of the Service at any time and for whatever reason. You are not obligated to advise Rydyt of such termination. However, if you would also like for Rydyt to delete your account and your personal information contained in the account, please use the “Delete Account” function in the in app Settings. On receiving such a request, Rydyt will use reasonable efforts to delete such information, however please note that information may not be deleted immediately from our back-up systems. The User may stop using the App, at any time and for any reason, and may at any time, request to cancel their registration and their data by sending a notice to Rydyt. Rydyt will de-activate such registration within a reasonable period of time after receipt of such notice.

Rydyt retains the right to block your access to the Service and discontinue your use of the Service, at any time and for any reason Rydyt deems appropriate, at its sole and absolute discretion.

Upon termination of the User’s account, Rydyt will close the User’s account and the User will no longer be able to retrieve information or data contained in the account. Notwithstanding any other provisions of these Terms of the App, any provision of these Terms of the App that imposes or contemplates continuing obligations on a Party will survive the expiration or termination of these Terms.

All copyright, trademarks, design rights, patents and other intellectual property rights (whether registered or unregistered) in the Services and all material or content made available by Rydyt via the Services (excluding any User Generated Content) are and will always remain the property of Rydyt (or Rydyt's licensors or third parties, as applicable).

Any data generated through the Products or Services be it User generated or not shall be the sole property of Rydyt. Generated data refers to data recorded or transmitted through use of the Products or the Services, not contributions or remarks by the User self. The gathered data is to be anonymized before use if not a separate agreement have been made between Rydyt and the User.

The names, images and logos identifying us, our partners or third parties and our/their products and services contained in the Services are proprietary marks and may not be reproduced or otherwise used without our express permission.

Nothing contained in these Terms grants you a licence or a right to use any copyright, trademarks, design rights, patents or other intellectual property right owned or controlled by Rydyt, its licensors or any third party, except to the limited extent necessary to receive the Services.

Although the App is essentially intended for use while on the move, the data of each session will be viewable only at the end of the session. The User must always pay close attention and ride appropriately taking into account road conditions and in accordance with the applicable Traffic Laws, including the laws relating to the operation of mobile devices while riding motor vehicles, and, where applicable, the regulations of the selected track.

Do not use the App for any illegal, unauthorized, unintended, unsafe, hazardous, or unlawful purposes, or in any manner inconsistent with these Terms.  

The User is solely responsible for the operation of their vehicle and the App. The User acknowledges and agrees that, under no circumstance, will Rydyt be responsible for any accident, damage, or liability that might occur to the User, the User’s property, or to third parties or their property, even if caused by using the App, unless such accident, damage, or liability arises as a direct consequence of Rydyt's acts or omissions.

Except as otherwise expressly provided in these Terms, and to the fullest extent permissible by applicable law, Rydyt makes no representations, warranties, guarantees or covenants and offers no other conditions (express or implied) regarding any matter including but not limited to the merchantability, suitability, fitness for a particular use or purpose other than those indicated in these Terms.

Notwithstanding anything herein to the contrary, the User’s use of the App is at the User’s sole risk. The User acknowledges and agrees that they assume full responsibility for their use of the App. The App is provided on an “as is” and “as available” basis. Rydyt disclaims any warranties that access to the App will be uninterrupted or error-free; that the App will be secure; that the App or the server on which the services are provided will be virus-free; that the App will work in combination with third party hardware, software or mobile applications; or that information on the App will be correct, accurate, adequate, useful, timely, reliable or otherwise complete. If the User downloads any content using the App, the User does so at its own discretion and risk. The User will be solely responsible for any damage to the User’s computer system or mobile devices or loss of data that results from the download of any such content. No advice or information obtained by the User from the App shall create any warranty of any kind.

To the fullest extent permitted by applicable law (including, without limitation, consumer protection law), neither Rydyt nor its affiliates, subsidiaries, licensors, suppliers or third party content providers nor their respective partners, officers, directors, shareholders, employees, agents, successors or assigns (“Rydyt Group”) will be liable for any indirect or consequential damages arising out of or relating to the App or injury arising from any use of the App, which is not attributable to Rydyt.

User will indemnify and hold harmless Rydyt Group from and against any and all claims, fines, penalties, liabilities, losses and other damages of any kind whatsoever (including attorneys’ and experts’ fees), incurred by Rydyt Group and shall defend Rydyt Group against any and all claims arising out of or in connection with User’s breach of these Terms of the App, User’s infringement of any third party right, including but not limited to any intellectual property or proprietary right, User’s misuse of the App, or the use of the App or the Service by any other person acting on User’s behalf or using User’s Access Data.
